These Terms and Conditions (“Terms”) govern all bookings and payments made through the checkout page of the Eimayan Adventures website (the “Site”). By proceeding with payment, you (“the Client,” “you”) confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not complete your booking.

1. Booking Confirmation

1.1 A booking is only confirmed once full or partial payment (as applicable) has been received and you have received a written booking confirmation from Eimayan Adventures via email.

1.2 It is your responsibility to review your booking details — including travel dates, destinations, number of travelers, and traveler names as they appear on passports — before completing payment. Errors must be reported to us immediately, as changes made after confirmation may incur additional charges.

1.3 All bookings are subject to availability. In rare cases where a package becomes unavailable after payment, we will offer an alternative package of equal value or a full refund of the amount paid.

2. Pricing and Currency

2.1 All prices displayed at checkout are quoted in [Insert Currency, e.g., USD/TZS] and are inclusive/exclusive of applicable taxes and levies as indicated on the checkout page.

2.2 Prices may be subject to change without notice due to factors such as park fees, government levies, fuel surcharges, or currency fluctuations. However, once payment has been made and a booking is confirmed, the price agreed at checkout will not change, except in cases of manifest error.

2.3 You are responsible for any additional bank charges, currency conversion fees, or transaction fees imposed by your bank or payment provider.

3. Payment Methods and Processing

3.2 By submitting your payment details, you confirm that you are authorized to use the selected payment method and that the information provided is accurate and complete.

3.3 Eimayan Adventures does not store your full card details on our servers. All payment card information is processed and encrypted by our third-party payment processor in accordance with applicable data security standards.

3.4 Depending on the package selected, you may be required to pay:

• A non-refundable deposit at the time of booking, with the balance due by a specified date before travel, or
• Full payment at the time of booking.

The specific payment structure for your booking will be clearly indicated at checkout.

3.5 If the balance payment is not received by the due date, we reserve the right to treat the booking as cancelled by you, subject to our Cancellation Policy in Section 5.

4. Identification and Travel Documents

4.1 As part of the booking process, you may be required to submit personal identification information, including passport details, national ID numbers, or visa documentation, to enable us to arrange permits, park entry, accommodation, and travel logistics on your behalf.

4.2 You are solely responsible for ensuring that your passport, visa, vaccination certificates, and any other travel documents are valid and meet the entry requirements of your destination(s). Eimayan Adventures is not liable for denied entry, missed travel, or additional costs resulting from invalid or missing documentation.

4.3 Personal identification information submitted during checkout is handled in accordance with our Privacy Policy.

5. Cancellation and Refund Policy

5.1 Cancellations must be submitted in writing (email) to Eimayan Adventures.

5.2 Refunds, where applicable, will be calculated based on how far in advance of the travel date the cancellation is received5.3 Deposits are generally non-refundable, as they are used to secure bookings with third-party suppliers (hotels, park authorities, airlines) on your behalf.

5.4 Refunds, where due, will be processed within [Insert e.g. 14–30] business days to the original payment method, less any non-recoverable third-party costs already incurred (such as permit fees, airline tickets, or non-refundable hotel deposits).

5.5 No refunds will be given for unused portions of a trip, early departure, late arrival, or no-shows, unless due to an act or omission of Eimayan Adventures.

5.6 We strongly recommend that all clients purchase comprehensive travel insurance covering trip cancellation, medical emergencies, and evacuation.

6. Changes to Bookings by the Client

6.1 Requests to amend a confirmed booking (such as travel dates or itinerary changes) are subject to availability and may incur additional fees charged by third-party suppliers.

6.2 Name changes or transfers of a booking to another person may not always be possible due to third-party supplier restrictions (e.g., airline tickets, park permits) and may incur additional costs.

7. Changes or Cancellation by Eimayan Adventures

7.1 We reserve the right to modify or cancel a booking due to circumstances beyond our reasonable control, including but not limited to adverse weather, political instability, government restrictions, supplier failure, or force majeure events (see Section 9).

7.2 In such cases, we will make reasonable efforts to offer a comparable alternative or a full/partial refund, depending on costs already incurred with third-party suppliers.

8. Liability

8.1 Eimayan Adventures acts as an agent in coordinating services provided by independent third parties, including but not limited to airlines, hotels, lodges, transport operators, and park authorities. We are not liable for the acts, omissions, negligence, or default of these independent third-party suppliers.

8.2 To the maximum extent permitted by law, Eimayan Adventures shall not be liable for any indirect, incidental, or consequential loss, including but not limited to loss of enjoyment, missed connections, personal injury, illness, loss of or damage to property, arising from your participation in a tour, except where such loss is caused directly by our proven negligence.

8.3 Travel, including safari and wilderness activities, carries inherent risks. By booking, you acknowledge and accept these risks and confirm that you are physically fit to participate in the activities included in your chosen package, unless you have disclosed relevant medical conditions to us in advance.

9. Force Majeure

Eimayan Adventures shall not be held responsible for any failure to perform, or delay in performing, its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, epidemics/pandemics, war, civil unrest, terrorism, government action, strikes, or extreme weather. In such events, we will work with you in good faith to reschedule or provide credit where possible, subject to third-party supplier policies.

10. Fraud Prevention

10.1 We reserve the right to verify the identity of the person making payment and to request additional documentation (such as a copy of the cardholder’s ID or the card used) before confirming a booking, particularly for high-value transactions.

10.2 We reserve the right to cancel and refund any booking suspected of being fraudulent, and to report suspected fraudulent activity to the relevant authorities and our payment processor.

11. Governing Law and Dispute Resolution

11.1 These Terms are governed by the laws of the United Republic of Tanzania.

11.2 Any disputes arising from a booking or payment made through this Site shall first be addressed through good-faith negotiation between the parties. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the United Republic of Tanzania, save for matters relating to personal data which may be referred to the Personal Data Protection Commission in accordance with the Personal Data Protection Act, 2022.

12. Amendments to These Terms

Eimayan Adventures reserves the right to amend these Terms at any time. The version of the Terms in effect at the time you complete your payment shall apply to your booking. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
